Together, your use of the Site and/or your engagement of our Services form a binding contract between you and us.By using the Site, requesting a quote, booking an appointment, or otherwise engaging our Services, you confirm that you have had a reasonable opportunity to read these Terms and that you accept them in full. Definitions• Customer / you: the person or entity that engages, or requests, our Services, or who uses the Site.• Equipment: any computer, laptop, component, peripheral or other device brought to us, or accessed remotely, for the purpose of the Services.• Services: computer and laptop sales, custom builds, upgrades, repairs, diagnostics, data recovery, remote support and any other IT-related service we agree to provide.• Site: our website at https://dnacomputers.com.au/ and any related pages.• Quote: a written or verbal estimate of the likely cost of Services, which is not a fixed price unless expressly stated to be a fixed quote.2. Information on this SiteAny information, statements or opinions on the Site (Information) are provided for general information purposes only and do not constitute professional advice. Any reliance you place on the Information is at your own risk.3. Amendment of these TermsWe may amend these Terms, our Site, or our prices from time to time, in our sole discretion, without prior notice, except that any Terms already agreed for a Service in progress will continue to apply to that Service. Your continued use of the Site after an amendment indicates that you accept the amended Terms.4. Your WarrantiesYou warrant to us that:(a) you have the legal capacity to enter into these Terms and to form a binding contract;(b) you have read and understood these Terms before using the Site or engaging our Services;(c) you are the owner of the Equipment, or you have the owner's authority to have the Equipment serviced and to authorise any work described in a Quote; and(d) all information you give us about the Equipment or fault is true and correct to the best of your knowledge.5. Licence to Use the SiteWe grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable licence to use the Site for your personal, non-commercial use, in accordance with these Terms. All other uses of the Site are prohibited without our prior written consent.6. Prohibited ConductYou must not use the Site to:(e) post or transmit material that you do not hold the necessary rights, licences or consents to use;(f) infringe the intellectual property or other rights of any person;(g) breach any law, regulation, rule, code or other legal obligation;(h) defame, harass, threaten, menace, offend or restrict any person;(i) post material that is obscene, indecent, defamatory, discriminatory or otherwise objectionable; or(j) bring us, or the Site, into disrepute.You must also not interfere with or inhibit any other user of the Site, send unsolicited messages through the Site, tamper with or damage the Site (including through viruses or malicious code), or help anyone else do any of the above.7. Quotes and EstimatesBefore starting any chargeable work, we will endeavour to give you a Quote for the Services. Unless we expressly state that a Quote is fixed, all Quotes are estimates only, based on the information and symptoms known to us at the time. The final price may vary if, once we begin work, we discover additional faults, the Equipment requires further parts or labour, or the scope of work changes with your agreement. We will use reasonable efforts to contact you before carrying out work that will materially increase the Quote.13. Diagnostic FeesWe are not responsible for delays or interruptions to the Site, or reasonable delays to the Services caused by matters outside our control, such as parts availability or supplier delays. We do not guarantee that the Site will be available at all times, and may discontinue the Site, in whole or in part, at any time without notice.21. Limitation of LiabilityTo the extent permitted by law, we exclude all liability for loss or damage suffered by you or any third party arising from your use of, or inability to use, the Site, or from the Services, except to the extent that liability cannot be excluded under the Australian Consumer Law or other applicable law. To the extent permitted by law, we exclude all representations, warranties or terms other than those expressly set out in these Terms and those implied by the Australian Consumer Law. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the Services or the cost of having the Services resupplied.22. TerminationThese Terms continue until terminated. We may terminate or suspend your access to the Site at any time, without notice, if we believe you have breached these Terms. We may decline to provide, or may stop providing, Services to you at any time, subject to clause 18 (Right to Refuse or Decline Service). Clauses that by their nature should survive termination (including clauses 16, 21, 22 and 23) will survive.26. Dispute ResolutionIf a dispute arises out of or in connection with these Terms, you agree to notify us in writing and to use reasonable efforts, including mediation and negotiation, to resolve the dispute before commencing court proceedings, except where you are seeking urgent interlocutory relief.27. Governing Law and JurisdictionThese Terms, and any dispute arising out of or in connection with the Site or the Services, are governed by the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.28. SeverabilityIf any provision of these Terms is found to be illegal, invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remainder of these Terms will continue in full force and effect.29. GeneralOur failure to act in relation to a breach of these Terms by you does not waive our right to act with respect to that breach or any later or similar breach.
